1. DESCRIPTIONS

3. RIGHTS AND OBLIGATIONS OF THE USER
The User reads the terms of this Agreement carefully before becoming a member of the site; 18 (eighteen) years of age; by filling in the information requested from it in the direction requested by its own free will and by selecting the "check" box during the membership procedures, it declares, accepts and undertakes that it is bound by the terms of this Agreement from the moment it completes the membership procedures.

3.1. RIGHTS OF THE USER
By purchasing the service package offered through the Site, the user can access the site using the username/password sent to the e-mail address provided by skyes car rental and shared with him/ her. To the extent that it fulfills its payment obligations, it has the right to carry out a car rental agreement with the parties that own the advertisement together with the vehicle advertisements selected within the framework of this Agreement. 3.2. USER'S OBLIGATIONS

· To provide accurate information during the membership phase, to inform SKYES CAR RENTAL immediately in case of a change in such information and to update its information through the website,
· After accessing the site with the password defined to it, the services subject to the Contract can be used by entering the password specified by it, and that it is exclusively responsible for the unavailability of the services due to incorrect entry of the username and/or password,
· To take care for the privacy and protection of the password it has determined,
· SKYES CAR RENTAL shall not be liable for any damages arising due to the use of the username and password by third parties,
· To prevent and/or immediately report such use in violation of this Agreement,
· To provide the necessary and adequate internet access to benefit from SKYES CAR RENTAL services,
· Using a device that supports access to the site and apps,
· To ensure the security of their connections and to take the necessary measures within this framework,
· To perform the service fee with a payment method accepted by SKYES CAR RENTAL,
· To follow the changes made to the terms of this Agreement and to leave the membership if it does not accept any change of interest,
· Not to transfer your account to a third party and to use it as a User
· In violation of this Agreement, we do not copy, transfer or display the content of the website,
· Not to infringe the intellectual property rights of SKYES CAR RENTAL,
· not to infringe intellectual property rights such as copyright, patent, trademark, trade secret or other proprietary rights of the content presented,
· not to use or distribute viruses, worms or similar harmful technologies that may harm the Site or other Users,
· Not to use any method of data mining, data collection or extraction,
The User acknowledges, declares and undertakes that all information provided by skyes car rental e-commerce site is accurate and complete, that it is not fake, that the business is responsible for any damages and losses that may be caused by the false and/or inaccurate of this information, and that the Site will compensate for any damages that may be incurable in this respect.

4. SKYES CAR RENTAL RIGHTS AND OBLIGATIONS

SKYES CAR RENTAL has the right to restrict use or terminate its membership at any time without the need to provide any notices, warnings or information in the event that one or more of the terms of this Agreement are violated by Members and Users.

SKYES CAR RENTAL does not provide car rental services on its behalf or account in any way in the mobile applications www.skyescarrental.com and SKYES CAR RENTAL. SKYES CAR RENTAL is only mediated to rent vehicles in price, location, features and model, which are predetermined by third-party car rental companies and uploaded to the databases www.skyescarrental.com and SKYES CAR RENTAL Mobile Applications.
SKYES CAR RENTAL communicates users' car rental requests to third-party car rental companies in the capacity of the operator/owner of the relevant vehicle; users are obliged to collect the rental fees they are obliged to pay to the third-party car rental company to the account of the third-party car rental company. The services you will purchase from the SKYES CAR RENTAL e-commerce site may be limited to "stock" amounts. The limitation is detailed on the rental car review and booking creation page. Due to the ease of purchasing products/services online and the possibility to take different orders at the same time, the related product/service may have sold out before it was purchased by you. SKYES CAR RENTAL determines the terms and rights of the sale in accordance with the Law no. 6563 on the Regulation of Electronic Commerce and its secondary regulations and the Law on Consumer Protection, the Regulation on Distance Sales and, where referred to, the Regulation on Door Sales. Your legal rights to purchase will also be presented on the "payment screen" when receiving services from the site. In terms of buyers who do not carry the title of consumer, the general provisions of the Turkish Commercial Code and the Turkish Debt Law will apply instead of the provisions of law no. 6502, the sales contract or the relevant articles of the Turkish Debt Law according to the type of service purchased. 5. PROTECTION OF PERSONAL DATA

The user must submit his/her requests regarding the processing, transfer and/or storage of his personal data under the Law via skyes car rental by the methods specified by the Law. SKYES CAR RENTAL will respond to and finalize the requests submitted under this Law free of charge as soon as possible, without any eventuality of thirty days. The Member has the right to opt out of these submissions free of charge at any time and not to receive messages for marketing and informational purposes.
SKYES CAR RENTAL will retain all approval records for sending electronic messages to it for marketing and promotional purposes by the Member for three years from the date of expiration of the validity of the approval and other records related to commercial electronic messages for three years from the date of registration.
6. INTELLECTUAL PROPERTY RIGHTS
SKYES CAR RENTAL and aryarentacar.com.tr word and shape brand and all kinds of slogans, designs, website design, software, domain names, code and other identifying/distinctive names and signs used in www.skyescarrental.com and SKYES CAR RENTAL mobile applications belong to SKYES CAR RENTAL. The User and Members may not use, share, distribute, copy, reproduce or otherwise use the distinctive/identifying name and mark subject to this and similar intellectual and industrial property rights without the prior consent of SKYES CAR RENTAL. The User is obliged to insify any damages suffered by SKYES CAR RENTAL and/or third parties if the User acts in a manner that infringes the intellectual and/or industrial property rights or commercial reputation of third parties and/or SKYES CAR RENTAL.
SKYES CAR RENTAL, hizmetlerinin sunulduğu internet sitesine dair tüm fikri mülkiyet haklarını saklı tutmaktadır. Kullanıcı’nın ücret ödeyerek SKYES CAR RENTAL hizmetlerini kullanması, Kullanıcı’ya üye olmasıyla birlikte erişebildiği içeriklere ilişkin herhangi bir mülkiyet hakkı kazandırmaz. İnternet sitesindeki ticari markalar, logolar, alan adları ve SKYES CAR RENTAL veya site içeriğindeki ilanları sağlayan araba kiralayan 3.kişilere aittir. İşbu Sözleşme, Kullanıcılara ve Üyelere SKYES CAR RENTAL ve/veya ilanların sahibi olan 3.kişilerin marka özelliklerini kullanma hakkını vermemektedir. Verilen hizmetler kapsamında 3.kişilerin internet sitesine koyduğu ve SKYES CAR RENTAL site içeriği olarak Kullanıcı’ya sunulan çalışmaların SKYES CAR RENTAL içeriklerin oluşturulmasına ilişkin kullandığı materyallere ilişkin sözleşmeleri kapsamındaki hak ve yükümlülükleri saklı kalmak kaydıyla kullanım hakları Kullanıcı’ya devredilmektedir.
İnternet sitesinin münhasır hak sahibi SKYES CAR RENTAL. İşbu internet sitesi üzerinde her tür organizasyon, kullanım ve tasarruf yetkisi SKYES CAR RENTAL ait olup Sözleşme şartları da dahil olmak üzere, uygulama ve uygulama uzantılarında mevcut her tür koşul, bilgi ve içeriğin, Kullanıcı’ya önceden herhangi bir ihtara gerek olmaksızın değiştirme hakkı saklıdır. Site içeriğinde bulunan tüm yazılım ürünleri, yazı, makale, fotoğraf, resim, tasarım, belge, animasyon, video ve bunlarla sınırlı olmamak üzere bütün ürünlerin her türlü fikri ve sınai mülkiyet hakları SKYES CAR RENTAL aittir. Bu ürün ve içeriklerin hiçbiri, SKYES CAR RENTAL yazılı izni olmadan kullanılamaz. Bu ürün ve içeriklerin herhangi bir amaçla kopya edilmeleri, tekrar üretilmeleri, habersiz ve izinsiz kullanımları ve dağıtımları yasaktır. Sitede yayımlanan fotoğraflar, video görüntüleri, animasyonlar, yazılar ve diğer yazılı ve görsel materyaller, SKYES CAR RENTAL izin alınmadan herhangi bir Platformda, sitede, mobil uygulama veya başka bir mecrada kısmen veya tamamen herhangi bir teknolojik yöntemle yayımlanamaz, kopyalanamaz, çoğaltılamaz, dağıtılamaz, içeriğinde ekleme, silme veya diğer herhangi bir değişiklik yapılamaz.
7. HİZMET BEDELİ VE FATURALAMA
Kullanıcı, Üye olabilmek için herhangi bir bedel ödemeyecektir. Araç kiralamak isteyen Üye Kullanıcılar ilanlarda belirtilen ücretleri SKYES CAR RENTAL tarafından kabul edilen ödeme yöntemi aracılığı ile peşinen ödemeyi beyan, kabul ve taahhüt ederler. Ödemenin doğru, eksiksiz ve zamanında yapılmaması durumunda içeriklere erişilemeyecek olup, kiralama işlemi gerçekleşmeyecektir. İşbu sebeple içeriklere erişilememesi halinde, sorumluluk münhasıran Kullanıcı’ya aittir. SKYES CAR RENTAL sitede her bir ilanda belirtilen ücretler üzerinden komisyon olarak bir ücret almaktadır.
Kullanıcı, sitede belirtilen ödeme yöntemi ile hizmet bedelinin Kredi/Banka Kartı’na yansıtılmasını kabul etmektedir. Kullanıcı, SKYES CAR RENTAL komisyon + kiralama bedelini tahsil etmek amacıyla herhangi bir zamanda değiştirme yetkisi tamamen kendisinde olan belirleyeceği bir ödeme servis sağlayıcısı ile çalışacağını, bu sebeple ödeme hizmetinin gerçekleşebilmesi için gerekli olan kişisel verilerinin ödeme servis sağlayıcısına aktarılacağını bildiğini ve bu işleme açıkça rıza gösterdiğini ve onay verdiğini, bu aktarım sürecinde yaşanabilecek veri ihlali faaliyetlerinden makul güvenlik önlemlerini alması halinde SKYES CAR RENTAL sorumlu tutmayacağını beyan, kabul ve taahhüt eder. SKYES CAR RENTAL, hizmet bedellerinde veya vergi oranlarında meydana gelen değişiklikleri hizmet bedellerine yansıtabilecektir. SKYES CAR RENTAL sitede kiralama ücretlerine eklediği komisyonunu değiştirme hakkı saklıdır. Ayrıca kiralama ilanlarındaki ücretleri ilanları koyan 3.kişiler belirlemekte olup bu ücretlerde meydana gelecek değişikliklerde SKYES CAR RENTAL hiçbir zarardan, fırsat kaybından sorumlu tutulamayacaktır.
8. CAYMA VE FESİH HAKKI
SKYES CAR RENTAL, Kullanıcı’nın bu Sözleşme’ye, Gizlilik ve Çerez Politikası’na ve/veya yürürlükteki ilgili mevzuata aykırı davranışlarını tespit etmesi halinde süre tanımaksızın Sözleşme’yi derhal feshetme ve Üyeliği sonlandırma hakkına sahiptir. SKYES CAR RENTAL, hizmetin sunuluş biçimindeki değişiklikler nedeniyle tek taraflı olarak, kısmen veya tamamen işbu Sözleşme çerçevesinde sağlamış olduğu hizmetleri Kullanıcı’larına sağlamaktan vazgeçebilir. Bu durumda Kullanıcı’ların herhangi bir tazminat isteme hakkı bulunmamakta olup, SKYES CAR RENTAL Kullanıcı’nın aykırı davranışı ve ihlali ile neden olduğu maddi, manevi, müspet ve menfi zararlardan doğacak tazminat haklarını saklı tutmaktadır.
Kullanıcı, işbu Sözleşme’yi üyelik hesabını kapatmak suretiyle veya SKYES CAR RENTAL bilgilendirerek herhangi bir sebep göstermeksizin istediği herhangi bir zamanda üyeliğini silerek sona erdirebilir.
Kullanıcı’nın üyeliğini iptal etmesi durumunda Gizlilik ve Çerez Politikası ve Aydınlatma Metni’nde detaylıca belirtilen haklarını, yine ilgi metinlerde belirtilen esaslar çerçevesinde kullanabilmektedir.
9. UYGULANACAK HUKUK VE YETKİLİ MAHKEME
İşbu Sözleşme Türk Kanunları çerçevesinde yorumlanacak olup, işbu Sözleşme’den doğabilecek uyuşmazlıklara uygulanacak hukuk, Türk Hukuku’dur.
İşbu Sözleşme’nin uygulanmasından doğabilecek uyuşmazlıkların çözümünde, Ticaret Bakanlığı'nca ilan edilen değerler dahilinde tüketici işleminin yapıldığı veya tüketicinin ikametgahının bulunduğu yerdeki Tüketici Hakem Heyetleri, söz konusu değerlerin üzerindeki uyuşmazlıklarda ise tüketici işleminin yapıldığı veya tüketicinin ikametgahının bulunduğu yerdeki Tüketici Mahkemeleri yetkili olacaktır.
Kullanıcı ile SKYES CAR RENTAL arasında gerçekleştirilen işbu hukuki işlemin tüketici işlemi olmaması halinde yukarıdaki madde uygulanmayacak olup uyuşmazlıkların çözümüne ilişkin yetkili merciinin belirlenmesinde 6100 sayılı Hukuk Muhakemeleri Kanunu hükümleri geçerli olacaktır.
Siparişin gerçekleşmesi durumunda Kullanıcı işbu Sözleşme’nin tüm koşullarını kabul etmiş sayılır.
10. YÜRÜRLÜK
İşbu Kullanıcı Sözleşmesi, Kullanıcı tarafından her hükmü okunarak tamamen anlaşılmıştır. Sözleşme, Kullanıcı tarafından elektronik ortamda onaylandığı an itibariyle yürürlüğe girmiş ve taraflardan biri feshedene kadar yürürlükte kalacaktır. Kullanıcı, Sözleşme koşullarını kabul ederek üyeliğini gerçekleştirmesi akabinde koşulların geçersiz olduğunu ve Sözleşme’yi kabul etmediğini iddia edemeyeceğini, Sözleşme koşullarını kabul etmemesi halinde SKYES CAR RENTAL işbu Sözleşme’yi herhangi bir zamanda feshetme hakkının saklı bulunduğunu bildiğini beyan, kabul ve taahhüt eder.
İşbu Kullanıcı Sözleşmesi’nin herhangi bir hükmü veya hükümlerinin geçersiz, yasalara aykırı veya uygulanamaz olduğunun tespiti durumunda, kalan hükümlerin geçerliliği, yasallığı ve uygulanabilirliği tam olarak yürürlükte kalmaya devam edecektir.
